David Pitre won an important appellate victory for his client and for all Mississippi insurance policyholders in a case where State Farm attempted to unfairly deny uninsured motorist (UM) coverage to its own customer. The insurance industry had been fighting this battle for years and had previously succeeded in convincing a federal appeals court to uphold this type of coverage exclusion. But in this unanimous decision from the Mississippi Supreme Court, the state law issue was finally put to rest, ensuring that innocent victims who paid a premium for UM insurance protection will be fairly entitled to recover their provable damages from State Farm (and all other insurers).
